Description:	La Suprema Corte de Justicia de la Nación en México ha ostentado un doble discurso respecto de lo que son los derechos humanos, uno público con una fundamentación sostenible pero difusa y uno que utiliza en sus resoluciones con tendencia positivista y sustentado principalmente en el neoconstitucionalismo de Ronald Dworkin, el cual resulta insuficiente como fundamento de los mismos. Por lo tanto, es de remarcable importancia la necesidad de actualizar y corregir el concepto de derechos humanos que la Suprema Corte de Justicia de la Nación utiliza como directriz para tomar las decisiones judiciales más importantes de México, y el sistema moral kantiano, como fundamento teórico de los derechos humanos, ofrece una base coherente a partir de la universalidad y necesidad de ese concepto para el desarrollo del ser humano y no solo para la tutela de la supremacía constitucional. The Supreme Court of Justice of the Nation in Mexico has held a double discourse about what human rights are, a public one with a sustainable but diffuse foundation and one that uses in its resolutions with positivist tendencies and based mainly on the Ronald Dworkin's neo-constitutionalism, which is insufficient as a basis for them. Therefore, is of remarkable importance the need to update and correct the concept of human rights that the Supreme Court of Justice uses as a guideline to take the most important judicial decisions of Mexico, and the Kantian moral system, as a theoretical fundament of the human rights, offers a coherent base from the universality and necessity of that concept for the development of the human being and not only for the protection of the constitutional supremacy.
