Título : ELEMENTOS DEMOCRÁTICOS EN LA CREACIÓN DEL SISTEMA JURÍDICO

Descripción : El presente producto de investigación aborda el problema de la legitimación del derecho desde una perspectiva de la filosofía jurídica, política y de la teoría social. Se plantea el problema de la falta de conectividad del sistema jurídico con las aspiraciones sociales de una nación. Para ello se presenta el desarrollo de la tesis en cinco capítulos que refieren, primero, al asunto de la verdad en general desde un plano filosófico, su descripción a la verdad jurídica y finalmente a la teoría discursiva de la verdad y una propuesta final de concepto de verdad jurídica; segundo, desde la filosofía jurídica se analiza la postura de cinco corrientes del pensamiento jurídico en relación a la producción normativa y cómo la legitiman, a saber, el iuspositivismo, el iusnaturalismo, el iusrealismo, el iusmarxismo y el neocontractualismo; tercero, desde la teoría social se explica y correlaciona a la legitimación social del derecho con el poder político, el poder económico, la cultura, y las consecuencias sociales que acarrea la ilegitimidad de éste; cuarto, se describen y explican desde la perspectiva jurídica los principales modelos democráticos, mismos que se vinculan con el tópico de la legitimación del derecho para luego determinar qué grado de contribución tienen éstos en lograr el consentimiento social de las normas y; quinto, se realiza una contrastación dialéctica entre las escuelas filosóficas democráticas y jurídicas, respecto de la producción normativa y su legitimación, proyectando las bondades y elementos cuestionables de cada una de ellas, contribuyendo lo anterior para que se presente un sistema integrador de democracia jurídica que embone las ventajas de cada uno para llegar a la formulación de tres presupuestos teóricos básicos: el objeto de una democracia jurídica, los sujetos de ésta y la agenda y su funcionamiento. Se concluye con un concepto de verdad jurídica, dialógica y discursiva; se afirma que existe una ilegitimidad del sistema jurídico por el dominio de poderes facticos y la flaqueza de la representación política; se cuestionan, pero también se estiman viables algunos componentes de las teorías jurídicas y democráticas, de las que se reconstruye un sistema y concepto de democracia jurídica.
The present research product addresses the problem of the legitimation of law from a perspective of legal philosophy, politics and social theory. The problem of the lack of connectivity of the legal system with the social aspirations of a nation is raised. To this end, the development of the thesis is presented in five chapters that refer, first, to the issue of truth in general from a philosophical point of view, its description to legal truth and finally to the discursive theory of truth and a final proposal of concept of legal truth; second, from legal philosophy the position of five currents of legal thought in relation to normative production and how they legitimize it is analyzed, namely, iuspositivism, natural law, iusrealism, iusmarxism and neocontractualism; third, from the social theory is explained and correlated to the social legitimization of the right with the political power, the economic power, the culture, and the social consequences that the illegitimacy of this one brings; fourth, the main democratic models are described and explained from the legal perspective, which are linked to the topic of the legitimation of the right and then determine what degree of contribution they have in achieving the social consent of the norms and; fifth, there is a dialectical contrast between democratic and legal philosophical schools, regarding normative production and its legitimacy, projecting the benefits and questionable elements of each of them, contributing the above to present an integrating system of legal democracy that embeds the advantages of each to arrive at the formulation of three basic theoretical assumptions: the object of a legal democracy, the subjects of this and the agenda and its operation. It concludes with a concept of legal truth, dialogical and discursive; it is asserted that there is an illegitimacy of the legal system due to the dominion of factical powers and the weakness of political representation; they question, but some components of legal and democratic theories are also considered viable, from which a system and concept of legal democracy is reconstructed.
