dc.descriptionLa investigación analiza los principios que sustentan al sistema de justicia tepehuana desde la antropología jurídica y la investigación indígena. Empleo ¿metodologías¿ y ¿paradigmas indígenas de investigación¿ a una etnografía en un pueblo o¿dam (tepehuanos del sureste) en el estado de Durango-México, grupo del cual formo parte. En este trabajo presento un acercamiento a los cuatro principios del sistema de justicia o¿dam: a) nosotros necesitamos estar curándonos, b) ser trabajadores, d) vivir bien y d) convivencia comunitaria. A partir del análisis antropológico de estos principios, se muestra, por un lado, el origen de sus normas, las cuales buscan preservar el ¿prestigio¿ individual y familiar. Así como la lógica de funcionamiento de sus autoridades, instituciones y procedimientos para la resolución de problemas. Se propone que el ejercicio de la justicia se basa en tres directrices jurídicos en los escenarios de regulación y solución: prevenir, conciliar y reincorporar al transgresor a la familia y a la comunidad. La presente tesis se suma a las propuestas de entender a las justicias indígenas desde sus/nuestros propios principios culturales, pues sólo de esta manera se pueden conocer sus/nuestras lógicas de regulación social.es_ES
dc.descriptionThis investigation considers the principles of the Tepehuan justice system (a northern Mexican indigenous group) from the perspective of legal anthropology and indigenous investigation. I apply indigenous `methodologies¿ and `paradigms of investigation¿ to the ethnography of the O¿dam (also known as the Southeastern Tepehuan) from the state of Durango-México, group to which I belong. This study illustrates the four pillars of the O¿dam justice system: a) we need to heal ourselves continuously; b) we need to be hard workers; c) we need to live well and d) we need to live in community. The anthropological analysis shows on one hand, the origin of O¿dam norms which seek to maintain the individual and family status; as well as the logic behind the authorities, institutions and procedures employed in conflict resolution: the prevention, conciliation and reincorporation of the transgressor back into family and community. This investigation further contributes to body of work that seeks to understand indigenous justice from their/our own cultural principles, since it is only from their/our point of view that the logic of social regulation can be understood.es_ES
