Description: "El objetivo de la presente Tesis es determinar los impactos económicos que produce en las personas físicas que perciben sueldos y salarios, el limitar las deducciones adicionales -personales- para efectos del ISR, respecto a lo establecido en los principios en materia fiscal en México. Se aborda con una metodología deductiva, ya que parte de lo general que son los principios doctrinarios económicos de Adam Smith y su correlación con los principios constitucionales tributarios aludidos en el artículo 31, fracción IV de la Constitución -Principio de Proporcionalidad y Equidad- pautas que deben observar los legisladores, al momento de crear las leyes tributarias, siendo menester señalar que lo particular se aterriza en la LISR -reformas a las deducciones personales y base gravable de las personas físicas subordinadas-, se precisa que es documental ya que se apoya de diversas leyes, obras de doctrinarios de derecho fiscal, páginas oficiales de la SCJN, OCDE, revistas especializadas en materia fiscal, así como periódicos financieros, en este orden de ideas es correlacional, derivado a que maneja dos variables, siendo en específico el sujeto activo o autoridad hacendaria y el sujeto pasivo o contribuyente, mismos que conforman la relación jurídica tributaria, es descriptiva ya que integra información de las variables precita, así como exploratoria, derivado a que no se han determinado los impactos económicos que conlleva la limitante a las deducciones citadas. Está estructurada en cuatro capítulos, en el primero de ellos se aborda la Introducción, en donde se cita la razón de ésta, y derivado a que es un trabajo deductivo, el segundo capítulo alude los Principios Constitucionales de las Contribuciones y sus Características en México; el tercer capítulo se estudian los Impuestos y sus Características y en el cuarto y último capítulo, se analiza El Impuesto Sobre la Renta y su Base Gravable. La revisión promedio de esta investigación es de cinco años. Ministros de la SCJN -tres-, revistas especializadas -dos-, PRODECON, concluyen que la limitante a las deducciones ocasionan un quebranto económico al sujeto pasivo aludido, lo cual se conviene ya que se deriva una base gravable mayor e irreal, que al aplicar la tarifa conducente se genera una mayor carga impositiva que violenta los principios en comento."
The object of this study is to determine the economic impact on individuals that receive wages and salaries produced by limiting additional – personal – deductions related to income tax in accordance with the established principles of tax matters in Mexico. An educational methodology is used since it stems from generalities which are the theoretical economic principles of Adam Smith and their correlation with the constitutional tax principles referred to in Article 31, Section IV of the Constitution – Principle of Proportionality and Equitableness – guidelines which should be observed by legislators when creating tax laws. In particular this is related to the Income Tax Law – reforms regarding personal deductions and the taxable base for individuals affected. The study is documental since it is based on different laws, doctrinarian works on tax law, official pages from the SCJN (Federal Supreme Court), OECD and journals specializing in tax matters, as well as financial periodicals. In this way it is correlational since it uses two variables, specifically the active subject, or tax authority, and the passive subject, or taxpayer, both making up the juridical tax relationship. The study is descriptive as it integrates information on the aforementioned variables and also exploratory since the economic impact leading to the limitation on the deductions mentioned has not been determined. The thesis is made up of four chapters. The first is Introduction in which the reason for the thesis is set forth, and derived from the fact that it is a deductive work, the second chapter refers to Constitutional Principles of Taxes and their Characteristics in Mexico. Chapter three studies Taxes and Their Characteristics. Chapter four, the last chapter, analyzes Income Tax and its Taxable Base. The average revision of this research is five years. Judges from the SCJN – three – specialized journals – two – and PRODECON conclude that the limitation on deductions causes the economic insolvency of the passive subject referred to, which is worthwhile since it leads to a greater and unreal tax base which, when the relevant tariff is applied, generates a greater negative burden which does violence to the principles referred to.
