dc.descriptionEl respeto a los derechos fundamentales es la razón primordial por la cual el Estado Mexicano reformó su Constitución así como el sistema de justicia penal, creando en esa medida el Código Nacional de Procedimientos Penales, el cual es de corte acusatorio y oral. Sin embargo, en este último se encuentran diversas disposiciones legales que lejos de proteger los derechos humanos de los inculpados, los transgreden, verbigracia, el derecho fundamental al debido proceso, en el que se encuentra la impugnación y la doble instancia. El artículo 468 de dicho código procedimental penal, dispone que no procederá el recurso de apelación contra aquellas sentencias definitivas dictadas por el juez de enjuiciamiento, en relación a aquellas consideraciones contenidas en la misma, distintas a la valoración de la prueba siempre y cuando no comprometan el principio de inmediación. Lo que significa que los tribunales de segunda instancia no podrán analizar o valorar pruebas cuando se apele una sentencia definitiva dictada por el juez de enjuiciamiento, a menos que comprometan el principio de inmediación, esto es, que las pruebas se hayan desahogado sin la presencia del juzgador. Pero resulta que en los casos de Herrera Ulloa Vs. Costa Rica y Norín Catrimán y otros Vs. Chile, la Corte Interamericana de Derechos Humanos, resolvió que efectivamente es un derecho fundamental el recurrir las sentencias condenatorias, aún con respecto a la valoración de pruebas, y que en esa medida, las disposiciones legales de los Estados partes que no lo contemplen así violan tales derechos fundamentales. Por ello, para el desarrollo del presente trabajo, se utilizará el método analítico, así como la utilización de métodos como el de la proyección, perspectiva y prospectiva, toda vez que estos permiten un acercamiento a una situación de futuro deseada. La técnica utilizada es la documental bibliográfica específicamente. Y en esa medida, la solución que se propone a la problemática que presenta el principio de inmediación, y a fin de respetar derechos fundamentales, como lo es el derecho a una segunda instancia, es que los Tribunales de Apelación o de Alzada, revisen íntegramente las sentencias definitivas dictadas por el juez de enjuiciamiento, tanto las cuestiones de facto (valoración de pruebas) como de derecho, aún y cuando al hacerlo no se observe el principio de inmediación, pues ello se salva a través del material estenográfico, taquigráfico o de audio-video que fue grabado en primera instancia, además de que así se respetan derechos fundamentales del inculpado.es_ES
dc.descriptionRespect for fundamental rights is the primary reason why the Mexican government amended its Constitution and the criminal justice system, creating to that extent the National Code of Criminal Procedure, which is an oral and accusatory procedure. However, in the latter we can find various legal provisions that far from protecting the human rights of the accused, transgress, for instance, the fundamental right to due process, in which the challenge and a second hearing are found. Article 468 of such criminal procedure code does not consider the right to appeal against those final judgments of the trial judge in relation to those considerations contained therein, different from the standard of proof, as long as they do not compromise the principle of immediacy. This means that the lower courts cannot analyze or evaluate evidence when a final judgment of the trial judge is being appealed, unless they compromise the principle of immediacy, meaning that the evidence has been vented without the presence of the judge. It turns out that in cases of Herrera Ulloa Vs. Costa Rica and Norín Catrimán et al vs. Chile, the Inter-American Court of Human Rights ruled that it is actually a fundamental right appealing against convictions, even with respect to the assessment of evidence, and, to that extent, the laws of the States Parties that do not consider it so, violate such fundamental rights. Therefore, for the development of this document, the analytical method and the use of methods such as projection, perspective and foresight, will be used, since these allow an approach to a desired future situation. The technique used is specifically documentary literature. And to that extent, the proposed solution to the problem presented by the principle of immediacy, and in order to respect fundamental rights such as the right to appeal, is that the courts of appeal or of Appeals fully review final judgments handed down by the judge, both de facto issues (tests assessment) and right, even if doing so the principle of immediacy is not observed, as this is saved through the stenographic equipment or video-audio previously recorded during the first trial, so also fundamental rights of the accused are respected.es_ES
